Chrushing victory for Apple against Samsung

ImageApple has won a crushing victory over Samsung in California.
The Jury found that Samsung had violated Apple patents and that Apple had violated none of Samsungs patents so Samsung must pay over one billion Dollars to Apple.

This is different from a week old decision in South Korean courts where the court found that Apple had infringed on two of Samsungs patents and Samsung had infringed on one of Apples.
So Apple was judged to pay Samsung a small amount but both were denied to sell the disputed products in the Korean market.

The Californian Jury did not find that Apple was violating any laws in the attempts to obtain monopoly.
This decision does not affect the latest Samsung Galaxy SIII


Here is Samsungs comment in the matter:
Today's verdict should not be viewed as a win for Apple, but as a loss for the American consumer. It will lead to fewer choices, less innovation, and potentially higher prices. It is unfortunate that patent law can be manipulated to give one company a monopoly over rectangles with rounded corners, or technology that is being improved every day by Samsung and other companies. Consumers have the right to choices, and they know what they are buying when they purchase Samsung products. This is not the final word in this case or in battles being waged in courts and tribunals around the world, some of which have already rejected many of Apple's claims. Samsung will continue to innovate and offer choices for the consumer.

And here is Apples:
We are grateful to the jury for their service and for investing the time to listen to our story and we were thrilled to be able to finally tell it. The mountain of evidence presented during the trail showed that Samsung's copying went far deeper than even we knew. The lawsuits between Apple and Samsung were about much more than patents or money. They were about values. At Apple, we value originality and innovation and pour our lives into making the best products on earth. We make these products to delight our customers, not for our competitors to flagrantly copy. We applaud the court for finding Samsung's behavior willful and for sending a loud and clear message that stealing isn't right.

If shapes are patentable nothing shall be built without paying the creators of the shapes; Cavemen perhaps?

The judge should be shot for allowing this frivolous case to win. :f

I heard this on the radio, driving home from the job, and was disappointed. One tech analyst was saying the verdict diverged from prior findings that certain common elements (rectangles, for godsake :f ) are not patentable, that this would probably form the basis for appeal. Makes me want to make a point to buy Samsung*, small comfort that must be, :berserk2 already hate apple.

Yes It clearly was a case of the Jury wanting to get home for the weekend.
It is really a symptom of a broken system. The US patent systems does clearly not promote innovation - it has become a mean to squash the competition.
Patenting the rectangle - are there words for how stupid that is?

This verdict does not matter anyway - it will be appealed.
And yes, if I have to cave in and buy a smartphone it will be a Samsung! +1

Neither Apple nor Samsung can be blamed much - it is the patent system that is completely broken. It does not work; especially not with software.

:think: Well, this logical outcome of laissez-faire capitalism --> immoral monopolism is, to say the least, unsatisfactory but it is a bit more complicated, perhaps. :wall:

Yes It must have been really easy to decide since it toke them only 21 hours. IMO they are just pawns in the patent game that involves Google Microsoft and Apple +++ regarding mobile phones.
The next logical step for Apple now is to attack Android probably together with Microsoft. That way they can decimate the competition even more.
The truth of the matter is that Android with the flagship Samsung Galaxy had left both Apple and Windows/Nokia behind. That does indicate that Samsung had a better product than the "original".
Interestingly the one company that made it big on the stock exchange was Nokia(Windows) - Samsung had a big fall.

Samsung toke the opportunity to praise the court because it was correct that they never have violated any Apple patents. This time it was about music...
In the US I think it was because Apple had invented the rectangle with rounded corners - or something... (Smart people you Americans; you have invented pretty much everything :-D )

Is the patent office in the USA is all screwed up.

A Monkey takes a piece of paper with poop and call it patent ######

So once is approve it the Monkey can sue to whoever poo on a piece of paper.

I was under the impression that if you patent some has to be some useful.
So far Apple have not made anything useful; just reproduced other people stuff and the court system let them get away with it.

On this win in reality, the extra publicity only helped Samsung.
They proved the point that you do not need to pay way too much for the crap Apple makes; someone else will deliver the same or better functionality for less.

once you get patent lawyers involved it is. considering they get large retainer fees plus percentage for every case they win

Yes how rude of Braun to use rounded corners on those squares in 1967 when they knew Apple were going to patent it. And Braun is not even American....
How dare they!
......
This makes the victory in the Californian court stand out as an act of patriotism more than blind justice.
Keep them coming!
Apple has truly gone bananas and it seems to be in the interest of the FBI that Apple gets the dominant market position.
There is something that does not smell right about this. Call me paranoid but they do not have to persecute me for it....
